Inkwell Markets LLC — Terms of Service

1. Agreement to Terms

By accessing or using inkwell.gg (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Inkwell Markets LLC, a Colorado limited liability company (“inkwell,” “we,” “us,” or “our”).

2. Description of Service

inkwell is a free, multi-game trading card game price analytics platform. We collect pricing data from multiple third-party sources, compute proprietary market estimates, and present analytics, trends, and market intelligence for trading card games.

inkwell is NOT a marketplace. No card sales, trades, or transactions occur on this platform. We do not buy, sell, broker, or facilitate the buying or selling of trading cards.

inkwell is NOT a financial advisor. See Section 5.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service.

4. Account Responsibilities

If you create an account, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and truthful registration information
• Promptly notifying us of any unauthorized use of your account

You may only maintain one account per person. inkwell reserves the right to terminate duplicate accounts.

5. Data Accuracy and No Financial Advice

IMPORTANT — READ CAREFULLY:

Prices displayed on inkwell are computed estimates derived from multiple third-party market data sources for informational purposes only. inkwell does not guarantee the accuracy, completeness, or timeliness of any pricing data. Market prices for trading cards fluctuate constantly and data may be delayed, incomplete, or inaccurate.

Nothing on inkwell constitutes financial, investment, or trading advice. Card market values fluctuate and past performance does not indicate future results. You should not rely solely on inkwell data for purchasing, selling, or investment decisions. Conduct your own research and consult appropriate advisors before making financial decisions.

inkwell expressly disclaims any liability for decisions made based on pricing data displayed on the Service.

6. Intellectual Property

inkwell’s Property

The following are the exclusive intellectual property of Inkwell Markets LLC:

• The inkwell Fair Value algorithm — the proprietary multi-source price computation
• All computed metrics — blended prices, volatility scores, trend analysis, and market intelligence scores
• The data pipeline and normalization processes — all proprietary data processing
• All original content — blog posts, market reports, editorial content, and UI/UX design

Unauthorized scraping, reproduction, reverse-engineering, or redistribution of this proprietary data is strictly prohibited.

Third-Party Content

Card names, set names, card images, game mechanics, rules text, and all related content are trademarks and copyrighted property of their respective publishers:

• Pokémon TCG— The Pokémon Company International
• Yu-Gi-Oh! — Konami Digital Entertainment
• Disney Lorcana — Ravensburger AG

• Flesh and Blood — Legend Story Studios

inkwell is not produced by, endorsed by, supported by, or affiliated with any trading card game publisher. Card data is used for reference and analytical purposes only.

Card images are served via third-party API providers and are the property of their respective owners.

7. Prohibited Conduct

You agree not to:

• Use any automated means (bots, scrapers, crawlers, or similar tools) to access, collect, or copy data from the Service without prior written consent from inkwell
• Reproduce, distribute, or create derivative works from inkwell’s proprietary computed data (inkwell Fair Values, analytics, market intelligence)
• Attempt to reverse-engineer or extract the inkwell Fair Value algorithm or any other proprietary process
• Use the Service in any way that violates applicable law
• Impersonate any person or entity
• Circumvent any technical measures we use to protect the Service
• Use the Service for any commercial purpose without our prior written consent

8. Affiliate Links

inkwell displays affiliate links to third-party retailers including TCGPlayer, eBay, and Card Kingdom. When you click an affiliate link and make a purchase, inkwell may earn a commission at no additional cost to you. See our full Affiliate Disclosure at inkwell.gg/affiliate-disclosure.

Affiliate relationships do not affect our price computations or the order in which cards are displayed.

9. User Content

Your portfolio positions, watchlist items, and price alert preferences (“User Content”) are private. They are never displayed publicly or shared with other users.

You retain ownership of your User Content. By submitting User Content, you grant inkwell a limited license to store, process, and use it solely to provide the Service to you. You may delete your User Content at any time by deleting the relevant items or by deleting your account.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

11. Third-Party Services

The Service contains links to and integrations with third-party services (including affiliate retailer sites, OAuth providers, and advertising networks). These third-party services are governed by their own terms of service and privacy policies. inkwell is not responsible for the practices or content of any third-party service.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, OR NON-INFRINGEMENT. INKWELL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INKWELL MARKETS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO:

(A) YOUR USE OF OR INABILITY TO USE THE SERVICE;
(B) ANY INACCURACY IN PRICING DATA DISPLAYED ON THE SERVICE;
(C) ANY PURCHASE OR SALE DECISION MADE IN RELIANCE ON THE SERVICE;
(D) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.

IN NO EVENT SHALL INKWELL’S AGGREGATE LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO INKWELL IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER. SINCE THE SERVICE IS FREE, THIS MEANS OUR LIABILITY TO YOU IS CAPPED AT $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, inkwell’s liability is limited to the greatest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Inkwell Markets LLC and its members, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

inkwell may suspend or terminate your account at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at support@inkwell.gg.

Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 12, 13, 14, 16, 17, and 18 survive termination.

16. Dispute Resolution

Informal Resolution: Before initiating any formal dispute, you agree to contact us at support@inkwell.gg and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration:If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Denver, Colorado, or virtually. The arbitrator’s award shall be final and binding.

Small Claims Exception:Either party may bring qualifying claims in small claims court in lieu of arbitration for disputes within that court’s jurisdictional limits.

Class Action Waiver: You agree to resolve disputes with inkwell individually. You waive any right to bring or participate in a class action, class arbitration, or representative action.

Exception: Either party may seek emergency injunctive relief in court to prevent irreparable harm while arbitration is pending.

17. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any court proceedings that are not subject to the arbitration clause above shall be brought in the state or federal courts located in Denver, Colorado.

18. General

Entire Agreement: These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and inkwell regarding the Service.

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force.

No Waiver:inkwell’s failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Changes: We may update these Terms from time to time. Material changes will be announced via email or prominent notice on the Service. Your continued use of the Service after changes are effective constitutes acceptance of the updated Terms.
